It's beyond the limits of Supreme Court
👉In the case of the petition filed in the Supreme Court by expelled Trinamool Congress MP Mahua Moitra, the Lok Sabha Secretariat has told the Supreme Court about the extent of its powers.
According to News reports flashed across media, In its reply, the Lok Sabha Secretariat referred to Article 122 of the Constitution. That said, the proceedings of Parliament (and its other constituents) cannot be questioned by alleging any irregularity in the process.
The Lok Sabha is the sole judge of the legality of the proceedings before it. The right to be elected to Parliament and the right to remain in Parliament is not included in any fundamental right. Therefore, Moitra's petition is not maintainable under Article 32 of the Constitution.
